a.General
These Product Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia and any disputes will be decided only by the Malaysian courts.

If any of these Product Terms & Conditions are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms & Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

Please read these Product Terms & Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Timogah makes the products available to you (“Product Terms”).

b. Prices
Please note that the prices on Timogah website are guided prices only and are only approximate. The total guided prices shown in the Customer’s shopping cart and order confirmation email may differ from the Customer’s final bill. When requesting goods by weight, Timogah reserves the right to supply goods with a weight difference. However Timogah shall make every effort to ensure the weight difference is minimal and as close to Customer’s request.

c. Delivery Information
We deliver to your home/office; 9am-5pm EVERYDAY.
Delivery will be made to the address specified by Customer on the completed order form.
We will deliver your order on the same day within 1-3 hours time or the next working day upon receiving your payment. Currently we only provide same day local pickup/delivery service within Kuching, Sarawak. We will expand our same day delivery service in other region nationwide as we grow our business.
We do deliver some items by courier throughout Malaysia. Email us at sales@timogah.com upon any enquiry.
Shipping to other division of Sarawak as well as to Sabah and Peninsular Malaysia is made through our courier partners; PosMalaysia and Gdex. We also deliver by bus express cargo service from Kuching to Miri in Sarawak, upon request by customers.

d. Returns & Refunds
When you buy from the Timogah Online Shopping website, we want you to be happy with your purchase. However, we know sometimes you may need to return goods.
If you placed an order but received the wrong item, you can return the wrong item (in its original or unused condition) for a refund or a replacement of the item within 14 days from the date of receipt of payment. We will not process any replacement or make any refund if we do not receive the returned item from you. Return shipping to us is at your own cost. Any return or refund issue must be made first by contacting us immediately through our email (sales@timogah.com).
If you receive a damaged or otherwise unusable fresh or frozen grocery item, you can request a refund through our email (sales@timogah.com). We won’t ask you to return the item.
e. Cancellation
Customer can cancel or change any of Customer’s current orders up to 12 hours before the shopping is due to be delivered. If in an emergency, the Customer needs to cancel the order beyond this time frame, Customer may email us at sales@timogah.com and we will try our best to help.

f. Payment
All payment have to be cleared before we proceed to process your order. All payment shall be made through:
– online payment
– direct online banking
– cash deposit machine (receipt needed)
– ATM bank transfer (receipt needed)
